'Expected to speak with responsibility’: SC slams BJP Minister for calling Col Sofiya Qureshi ‘sister of terrorists’

The Supreme Court on Thursday reprimanded Madhya Pradesh cabinet minister Kunwar Vijay Shah for making controversial remarks against Indian Army officer Colonel Sofiya Qureshi, who briefed the media about Operation Sindoor against Pakistan. Shah’s comments sparked controversy after a video of his speech circulated widely on social media. The Madhya Pradesh High Court took suo motu cognisance of the matter and ordered the registration of an FIR against him.

The High Court directed the police to file the FIR under Sections 152, 196(1)(b), and 197(1)(c) of the Bharatiya Nyaya Sanhita (BNS). The order was passed by a division bench of the High Court, which instructed the Director General of Police (DGP) to ensure immediate registration of the FIR. The court observed that Shah’s statement had the propensity to cause disharmony and ill-will between members of the Muslim community and others. The court further warned that failure to register the FIR could result in contempt proceedings against the police leadership.

Shah approached the Supreme Court challenging the Madhya Pradesh High Court’s May 14 order directing FIR registration. During the hearing, the bench comprising Chief Justice BR Gavai and Justice AG Masih stated, “Holding a constitutional position, you should have exercised a degree of restraint, especially when the country is undergoing such a situation.” The Supreme Court refused to stay the FIR or halt the ongoing proceedings and directed Shah to seek relief from the High Court.

In response to the controversy, Shah issued an apology, stating his remarks were taken out of context. He said, “Colonel Sofiya Qureshi is above my real sister, who performed the national religion and took revenge on those people. She is more important than my real sister.” He further apologized, saying, “If something slipped out in anger and someone felt bad, then I would like to say that I am not a god; I am also a human being. I apologise ten times for it.” Shah identified himself as a patriotic man with a military family background.

Following the High Court’s directive, Madhya Pradesh Chief Minister Mohan Yadav’s office announced that instructions had been given to take action regarding Shah’s statement. The FIR registration and investigation are ongoing, while the Supreme Court has scheduled to hear Shah’s plea on May 16. The High Court continues to monitor compliance with its order to ensure timely legal proceedings.
