The Bombay High Court on Friday criticised the Indian Navy for raising objections late against a high-rise building near INS Shikra in Colaba. The court observed that the construction, ongoing since 2024, should have been flagged earlier if it posed a security concern.
A bench noted that the building had gradually reached more than 20 storeys and nearly 70 metres in height, yet went unnoticed despite regular movement of high-profile officials in the area. The court termed this a prima facie “failure of intelligence” and questioned how the structure escaped attention for so long.
The court directed the developer not to create third-party rights and warned that floors could face demolition if mandatory clearances were found missing. It also asked the Brihanmumbai Municipal Corporation to respond and cautioned that officials could face prosecution if permission was granted negligently.
The Navy had approached the court claiming the structure overlooks the naval installation and poses a security risk. The court said further construction would be at the developer’s own risk until the matter is finally decided.
