In a major development in the West Bengal SIR case, the Supreme Court of India on Monday directed the National Investigation Agency to take over the investigation, invoking its plenary powers under Article 142 of the Constitution. The court also ordered that all records and materials collected by the state police be handed over immediately, while allowing the NIA to register fresh FIRs if additional dimensions emerge during the probe.
The court further directed that individuals arrested so far by the state police be handed over to the NIA for independent interrogation. Senior advocate Siddharth Luthra, appearing for the state authorities, informed the bench that two persons were currently in police custody. The bench ordered that their custody be transferred to the central agency, underlining the need for a comprehensive and impartial investigation.
During the hearing, the court was informed that the NIA had already conducted a preliminary inquiry and submitted a status report in a sealed cover. The agency highlighted that multiple FIRs had been registered, including cases involving alleged obstruction of judicial officers and incidents of blockades. The bench noted serious concerns regarding the handling of the situation and emphasised that the investigation must reach its logical conclusion under independent supervision.
At the same time, the court issued directions related to the Special Intensive Revision process, instructing that verified names be included in the supplementary voter list by the same night. It also posted the matter for further hearing on April 13, while making strong observations on administrative lapses and reiterating the need for accountability and procedural integrity in handling election-related processes.
