The Calcutta High Court on Monday quashed the West Bengal Medical Council’s (WBMC) order that cancelled the medical registration of Dr Santanu Sen in connection with his foreign qualification. The court stated that the Council’s order lacked clarity on the reasons behind the suspension and did not specify the charges against him. Observing procedural lapses, the court directed that Dr Sen is entitled to refer to his qualification as a “Diploma Fellowship” on his official letterhead.
The High Court’s ruling clarified that the WBMC had failed to issue a formal notice or detail the nature of the alleged misconduct before cancelling the registration. The court held that such an action without explanation or hearing could not be sustained. However, it also noted that the Council is permitted to initiate fresh legal proceedings if done in accordance with law and with appropriate procedural compliance.
