Delhi liquor policy case: K Kavitha moves SC against ED summon

Delhi liquor policy case: K Kavitha moves SC against ED summon

Telangana Chief Minister K Chandrashekhar Rao's daughter K Kavitha on Wednesday moved the Supreme Court against the summons issued by the Enforcement Directorate for questioning on Thursday in connection with the Delhi consumer policy case. 

The Supreme Court refused immediate hearing of Kavith's plea when it posted the matter on March 24. Kavitha, currently an MLA from the Nizamabad Local Bodies constituency, claims that she is not named in the FIR and that the summons is under Section 160 of the CPC, which provides that no woman shall be required to appear as a witness at any place other than the place, where does he live.

Kavitha was asked to appear before the ED in Delhi to allegedly confront her arrested in the case. She said the ED gave her a very short summons to appear and denied her requests for an examination at her residence or an extension of the examination date. During this appearance, the former MP claims that he was subjected to several illegalities by the ED. She says she was forced to produce her mobile phone while being summoned under Section 50(2), 50(3) of PMLA which do not require production of mobile phone.

The agency then allegedly seized her device and interrogated her, a lady, long after sunset. There was no confrontation with any arrestees, she added. She was also given another summons to appear on March 16, which is tomorrow. Kavitha further claims that the ED deliberately leaked her personal contact details in the garb of filing a remand application against one of the accused in the case and then the CBI served her a notice and interrogated her for almost 7 hours.

Her plea alleges that the ED adopted highly coercive tactics and third-degree measures in connection with their alleged investigation.
