In a significant development, the Supreme Court, led by Chief Justice DY Chandrachud, has directed the Election Commission of India (ECI) to organize elections in Jammu and Kashmir by September 30, 2024. The directive came during the hearing of a batch of petitions challenging the abrogation of Article 370, which granted special status to the erstwhile state.
The five-judge Constitution bench, including Justices Gavai, Surya Kant, Sanjay Kishan Kaul, and Sanjiv Khanna, assembled to pronounce judgments and upheld the government's decision to abrogate Article 370. Chief Justice DY Chandrachud clarified that Article 370 was a temporary provision, and the president had the authority to revoke it. Additionally, the bench affirmed the validity of creating the Union Territory of Ladakh, separate from Jammu and Kashmir.
