SC orders immediate release of minor students arrested in paper leak protests

The Supreme Court directed states to immediately release all students below the age of 18 and those without criminal antecedents who were detained during nationwide protests over examination paper leaks. A three-judge bench led by Chief Justice Surya Kant clarified that protection would not extend to individuals with prior criminal backgrounds. In addition, the court ordered that no coercive action be taken under FIRs registered against students participating in demonstrations led by the Cockroach Janta Party (CJP) at Jantar Mantar and across multiple states.

Hearing a batch of petitions regarding alleged police brutality—including incidents during the July 20 Parliament march—the apex court indicated it may constitute a high-powered committee to investigate allegations of excessive force by police as well as attacks on security personnel. The court issued notices to the Centre and several state governments, directing authorities to preserve all digital evidence, including CCTV, body camera, drone footage, and communication logs. Furthermore, the court strictly prohibited the public disclosure of personal data or details belonging to the student protesters.

Emphasizing that peaceful protest is a constitutionally protected right, Chief Justice Surya Kant highlighted the urgent need for a standardized nationwide police protocol to manage public demonstrations. The court expressed serious concern over allegations regarding the use of pellet guns, electric batons, and nail-embedded sticks against demonstrators. Meanwhile, Solicitor General Tushar Mehta stated that nearly 250 police personnel were injured during the July 20 clashes, raising concerns that criminal elements may have infiltrated the student movement. The matter is scheduled for further hearing on August 3.
