The Supreme Court on Thursday dismissed an appeal by BJP leader Shubhendu Adhikari challenging an order of the Calcutta High Court refusing to interfere in the West Bengal panchayat election process.
A bench of Chief Justice DY Chandrachud and Justice JB Pardiwala asked how it could stop the election midway when it is already scheduled. The bench said, “Staying elections is a serious matter and we cannot do that. We will not interfere.
Senior advocate PS Patwalia appeared for BJP MLA Adhikari, who is the Leader of the Opposition in the West Bengal Legislative Assembly.
The Calcutta High Court had on March 28 declined to interfere with the West Bengal panchayat election process at this stage, while holding that there was merit in the petitioner officer's argument on the seat reservation criteria for the election.
The High Court had observed that any interference at this stage with regard to the PIL filed by the officer could lead to postponement of the Panchayat elections in the State. The court left it to the State Election Commission to decide on the points raised by the BJP MLA on such reservation of seats.
