Rani Kapur, mother of late businessman Sunjay Kapur, has approached the Delhi High Court alleging that her daughter-in-law Priya Kapur used a fraudulent trust to unlawfully divert the Kapur family’s estate. In a detailed civil suit, she has sought a declaration that the RK Family Trust, purportedly created in October 2017, is illegal, void and the result of fraud, forgery and undue influence.
The suit claims that a complex web of illegal transactions led to all of Rani Kapur’s assets being vested in the RK Family Trust without her knowledge or consent. She has sought dissolution of the trust, restitution of assets, rendition of accounts and permanent injunctions restraining the defendants from acting upon or benefiting from the impugned trust.
Rani Kapur alleged that the alleged fraud came to light only after the death of her son Sunjay Kapur, who died in London in June last year. While his death was officially attributed to cardiac arrest, she has claimed that it occurred under suspicious circumstances and hinted at a larger conspiracy.
According to the suit, Rani Kapur is the sole beneficiary and legatee of the estate of her late husband, Surinder Kapur, founder and promoter of the Sona Group, who died in 2015. His will, executed in February 2013 and probated in January 2016, bequeathed all movable and immovable assets, including company shareholdings, exclusively to her, without objections from their children.
The plea further states that after suffering a stroke in 2017, Rani Kapur became dependent on her son and Priya Kapur, during which period her assets were allegedly siphoned into the RK Family Trust. She claimed she had already created two valid trusts in 2016, and that the disputed trust excluded her as a beneficiary and stripped her of control.
The suit names multiple family members as defendants and alleges that following Sunjay Kapur’s death, Priya Kapur swiftly assumed control of key companies and restricted Rani Kapur’s access to information. Rani Kapur has sought restoration of her estate and family legacy as it existed prior to the creation of the disputed trust.
