UP Congress MP Rakesh Rathore arrested during press conference on rape charges after HC denies bail

Congress MP Rakesh Rathore was arrested on Thursday in Sitapur, Uttar Pradesh, in connection with a rape case filed against him by a 45-year-old woman. Rathore, who represents the Sitapur constituency in the Lok Sabha, was apprehended while he was addressing a press conference at his residence. His arrest follows a two-week-long search after the case was registered on January 17. The woman accused Rathore of sexually exploiting her over four years, under the false pretense of marriage and helping her build a political career.

The charges against Rathore include rape (IPC Section 376), criminal intimidation (IPC Section 351), and threatening with a firearm (IPC Section 327). The Sitapur Police had been searching for Rathore since the FIR was filed, conducting raids in Sitapur, Lucknow, and other cities. Rathore had evaded arrest during this period, despite multiple notices being served. On January 21, a notice was issued at his Sitapur residence asking him to clarify the allegations, but Rathore did not respond, continuing to avoid authorities.

Rathore had filed a petition for anticipatory bail, but the Lucknow bench of the Allahabad High Court rejected his plea on Wednesday. The court directed Rathore to surrender within two weeks at the Sitapur district and sessions court. Rathore's defense team argued that the case was filed after a four-year delay, suggesting it was a false accusation. However, the prosecution contended that the delay was due to the fear of Rathore’s political influence and the power imbalance that prevented the woman from reporting earlier.

On Thursday, as Rathore held a press briefing at his residence, Sitapur Police acted on intelligence about his location and raided his house around 1:30 PM. They arrested him at the scene of the press conference. He was subsequently taken to the City Kotwali police station for further legal proceedings. The police confirmed that Rathore would be presented before a court, where further actions would be determined.

The investigation into the case continues, with authorities confirming that additional charges could be filed based on further evidence. The police have stated that Rathore’s arrest marks a significant step in the ongoing legal proceedings. Following his arrest, Rathore's political future remains uncertain, and legal experts suggest that the case could have long-term consequences for his career.

The case has sparked political debate in Uttar Pradesh, with Uttar Pradesh Congress Committee (UPCC) president Ajay Rai calling for a judicial inquiry into the allegations against Rathore. The inquiry aims to ensure a fair and transparent investigation into the charges. As the investigation progresses, Rathore’s legal team has indicated plans to challenge the charges in court, leading to a prolonged legal battle.
