In a landmark judgment, the Supreme Court of India has ruled that women Short Service Commission (SSC) officers in the armed forces will be entitled to pension benefits, even if they were released after 14 years of service. The court invoked its extraordinary powers to grant this as a one-time relief, addressing long-standing concerns over gender disparity.

The bench held that women officers who were considered for Permanent Commission but were denied it would be deemed to have completed 20 years of qualifying service for pension purposes. Under existing rules, a minimum of 20 years of service is required to qualify for pension, effectively excluding most SSC officers who typically serve up to 14 years.

The ruling came on petitions filed by women officers, including Sucheta Edan, who challenged the denial of Permanent Commission under policy changes introduced in 2019. The court observed that the evaluation framework applied to these officers was flawed and did not provide them a fair opportunity to meet newly introduced performance criteria.

Highlighting systemic issues, the court noted that the performance benchmarks and service length criteria were applied without adequate transition time, placing women officers at a disadvantage. It also flagged that such criteria should not have been used to determine unsuitability when officers were not given a proper chance for career progression.

The court directed that all women SSC officers considered in selection boards held between 2019 and 2021 would be eligible for pension and related benefits, with effect from November 1, 2025. However, it clarified that no arrears of pay would be granted. The ruling also stated that serving officers would be eligible for Permanent Commission subject to meeting prescribed criteria, marking a significant step towards ensuring gender parity in the armed forces.
