The division bench of the High Court, comprising Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharya, has upheld the operation of hookah bars in Kolkata and Bidhannagar. Challenging the decision of a single bench, the Kolkata Municipal Corporation (KMC) sought the closure of hookah bars, citing public health concerns.

During the hearing, hookah bar owners argued against the closure, asserting the absence of any specific legislation authorizing such action. After a rigorous question-answer session, the division bench affirmed the single bench's order and emphasized the necessity for the state government to enact appropriate laws before considering any ban.
