Justice Tirthankar Ghosh of the Calcutta High Court has recused himself from the RG Kar rape and murder case. The plea for fresh investigation and surveillance in the investigation is likely to be heard by the division bench of Justice Debangshu Basak. Instead of the single bench of Justice Tirthankar Ghosh, the case will be heard by the division bench for the time being. He sent the documents of this new petition filed by the family of the deceased to the Chief Justice.
In the context of this case, Justice Tirthankar Ghosh said that since the CBI and the convicted accused have already filed a new case in the Division Bench of the High Court, and the hearing of that case is underway, it is desirable that this case be heard by the Division Bench instead of the Single Bench.
The two cases filed on this issue are now pending in the division bench of Justice Basak. The family's case was filed in December last year in the bench of Justice Tirthankar Ghosh demanding a fresh investigation. The victim's parents filed a case in the Calcutta High Court expressing dissatisfaction with the CBI investigation. In the petition, it was stated that they did not have faith in the CBI investigation. A new investigation should be formed by forming an SIT. That case was pending in the court of Justice Tirthankar Ghosh. The victim's parents also approached the court seeking to visit the crime scene again. After the lower court dismissed that petition, it went to the bench of Justice Tirthankar Ghosh. He also withdrew from that.
