SC stays controversial UGC rules, seeks Centre's reply

The Supreme Court on Thursday stayed the implementation of the University Grants Commission’s 2026 equity regulations, observing that the framework was capable of dividing society and could have dangerous consequences if misused. The court ordered that the UGC’s 2012 anti-discrimination regulations would continue to operate for now to ensure complainants are not left without remedies.

A bench led by Chief Justice of India Surya Kant, along with Justice Joymalya Bagchi, issued notice to the Union government and the UGC on petitions challenging the constitutional validity of the 2026 regulations. The court said unity must be reflected in educational institutions and expressed concern that the new provisions were vague, omnibus and vulnerable to exploitation.

During the hearing, the bench flagged multiple concerns, including the narrowing of protections compared to the 2012 framework and the absence of clarity on issues such as ragging. It questioned whether the regulations marked a regression in India’s constitutional journey towards a casteless and inclusive society, cautioning against measures that could lead to exclusion or reverse victimisation.

Staying the regulations, the court clarified that the interim arrangement was necessary to prevent a legal vacuum while the constitutional challenge is examined. The matter has been listed for further hearing on March 19, as the court seeks detailed responses from the Centre and the UGC.
