Bike restrictions ahead of polls challenged in Calcutta HC, hearing scheduled for April 23

The Election Commission’s restrictions on motorcycle movement ahead of the elections have been challenged in the Calcutta High Court, with the matter set for hearing on April 23. Justice Krishna Rao has allowed the petition to be filed after concerns were raised that the curbs could significantly disrupt daily life and mobility for ordinary citizens. The challenge comes just days before the crucial phase of polling, adding a legal dimension to election-related regulations.

The controversy stems from a notification issued by the Election Commission on Tuesday, which imposed multiple restrictions on the use of motorcycles. According to the guidelines, no bike rallies will be permitted from two days before polling. During this period, motorcycles can be used only between 6 AM and 6 PM, and pillion riders are not allowed. On polling day, bike usage is restricted to essential purposes such as voting or emergencies within the same time window.

The Commission, however, clarified that exemptions would apply in specific situations, including medical emergencies, family needs, and school-related travel for children. Individuals attending social events are also exempt from the restrictions. Additionally, app-based transport services like Rapido will not fall under the curbs. For any other exceptions, individuals must obtain prior written permission from the local police station.

Despite these relaxations, the petitioner has argued that the restrictions impose unnecessary hardship on common people and professionals, including lawyers, by limiting their ability to travel for work or urgent matters. The plea further contends that such restrictions interfere with the fundamental right to freedom of movement. With the High Court now set to hear the matter, the final outcome could have significant implications for election-time regulations and public convenience.
