The Supreme Court has sent the rape case against senior BJP leader Kailash Vijayvargiya to the lower court and directed that a fresh hearing be conducted.
The case has been referred to the Chief Judicial Magistrate in Alipore, Kolkata. An FIR was lodged against Vijayvargiya, Jishnu Basu, and Pradeep Joshi in December 2021 following a woman's allegation of gang rape at Vijayvargiya's apartment. The Kolkata High Court had ordered the FIR's registration, which the lower court had rejected.
The Supreme Court's decision to refer the case to the lower court comes after a series of appeals and counter-appeals by the parties involved in the case.
The case dates back to December 20, 2021, when the Kolkata High Court ordered the registration of an FIR against Vijayvargiya, Basu, and Joshi following the woman's complaint. However, the lower court had dismissed the complaint and refused to register the FIR. In response, the High Court quashed the lower court's order and directed the FIR's registration.
Subsequently, Vijayvargiya and others challenged the High Court's order in the Supreme Court. The apex court has now referred the case to the lower court for a fresh hearing, indicating that the legal battle over the case is far from over.
