Gangster Atiq Ahmed's sister moves Supreme Court, demanding answers on 'Encounter Killings'

The sister of gangster politician Atiq Ahmed and Ashraf Ahmed, who were shot dead in police custody in Uttar Pradesh on April 15, has petitioned the Supreme Court for a comprehensive probe by a retired judge or an independent agency into the alleged "extrajudicial killings" by the government.

The suit filed by Aisha Noori also seeks an investigation into the murder of her nephew and son Atiq Ahmed. She has asked an independent agency for a comprehensive probe into the Uttar Pradesh government's campaign of "encounter killing, arrest and harassment" targeting her family.

The lawsuit said an independent investigation into "custodial and extrajudicial killings" was needed to catch the high-level state agents who planned and orchestrated the campaign to kill members of her family.

In the lawsuit, she informed the court about the incident and called it a state-sponsored murder. He sought a comprehensive inquiry into the campaign of extrajudicial killings carried out by the respondents by a commission headed by a former Supreme Court judge or, alternatively, by an independent agency.

“The respondents are responsible for the deaths of the petitioner's brothers, late Khalid Azim alias Ashraf and late Atiq Ahmad, as well as other family members of the petitioner, which occurred within days of each other,” she said. in the lawsuit.

The petitioner has highlighted the fact that the deaths of the petitioner's family members and others are linked to the brutal, arbitrary and illegal campaign of the Uttar Pradesh Government. In the absence of such a comprehensive and independent investigation, the rights of the petitioner and her family members under Article 21 of the Constitution would be violated, as Article 21 of the Constitution imposes a positive procedural duty on state authorities to effectively investigate the deaths of the petitioner's family members.

The petitioner sought a direction calling for a comprehensive inquiry by an independent agency into the Uttar Pradesh government's campaign of killing, arrest and harassment against the petitioner's family and directed the respondents to follow the directions issued by the apex court in investigating custodial and extrajudicial deaths of the family members of the petitioner and their associates.

The petitioners also sought to comply with the high court judgment and register an FIR for offenses under Sections 302, 201, 120-B and 193 of the Indian Penal Code against the police officers who conducted the alleged encounters leading to the death of the petitioner's family members and their associates.
