FIR filed against Delhi CM Atishi for alleged misuse of Govt vehicle in election campaign

Delhi Chief Minister Atishi has been booked in a First Information Report (FIR) for allegedly violating the Model Code of Conduct (MCC) ahead of the 2025 Delhi Assembly elections. The FIR was filed at the Govindpuri police station in southeast Delhi, based on a complaint by the returning officer of the Kalkaji constituency. The complaint accuses Atishi of using a government vehicle from the Public Works Department (PWD) to deliver election campaign materials to the Aam Aadmi Party (AAP) office. The complaint claims this was done after the election announcement on January 7, which triggered the implementation of the MCC.

The MCC restricts the use of government resources, including official vehicles, for electioneering purposes. As per the regulations, the use of government vehicles for political purposes is strictly prohibited during election periods. Police officials confirmed that the FIR was filed under section 223(a) of the Bhartiya Nyay Sanhita (BNS), which pertains to disobedience to orders from a public servant. The penalty for violating this provision can include a fine of up to ₹2,500 or imprisonment for up to six months. In cases where disobedience threatens human life or public safety, the punishment can increase to one year in jail or a fine of up to ₹5,000.

The complaint was filed by Kalkaji resident KS Duggal, who alleged that the PWD vehicle was used to transport election-related materials to the AAP office in Kalkaji. Following the complaint, the returning officer instructed the police to take immediate action against South-East Divisional Executive Engineer Sanjay Kumar, who is said to have facilitated the use of the vehicle. The Delhi Police have initiated an investigation into the matter.

Atishi, who is the incumbent MLA from Kalkaji, has been renominated by the Aam Aadmi Party (AAP) to contest the upcoming elections. The BJP has fielded Ramesh Bidhuri, a former Member of Parliament, to contest from the same constituency. Atishi’s nomination process, which was initially set to take place on January 14, was delayed due to the ongoing controversy surrounding the FIR. Despite the issue, she was seen participating in a roadshow with AAP leaders, including Manish Sisodia, and later decided to engage with Election Commission officials regarding the matter.

The FIR has drawn attention in the context of the broader Delhi Assembly elections, scheduled for February 5. The Model Code of Conduct applies once the election schedule is announced, imposing strict regulations on the conduct of political parties and candidates. It is designed to ensure a fair and free election process by preventing the misuse of official resources and ensuring equal opportunities for all political parties. The Delhi Police have not provided further updates on the investigation, and the Election Commission has yet to issue any statement on the matter.

The Delhi Assembly elections are set to be a three-cornered contest between AAP, BJP, and Congress, with each party vying for control of the national capital. AAP, which has been in power in Delhi since 2015, aims for a third consecutive term. The results of the elections will be announced on February 8. The Kalkaji constituency is expected to be one of the most closely watched constituencies in this election, given the high-profile candidates from AAP and BJP.
