Calcutta HC questions EC’s transfer drive, seeks data on IAS and IPS reshuffle

A sharp legal and political confrontation has emerged ahead of the West Bengal Assembly elections, with the Calcutta High Court seeking a detailed report from the Election Commission of India on the recent large-scale transfer of officials. Hearing a petition challenging the overnight reshuffle, the court has directed the Commission to submit a complete list of transferred officers, including details of their postings and the number of IAS and IPS officials affected.

Defending its actions, the Election Commission asserted that ensuring free and fair elections falls squarely within its constitutional mandate. It argued that it has full authority to transfer or remove any official who may influence the electoral process, maintaining that such decisions are necessary to uphold neutrality during elections. The Commission also termed the petition a “disguised” plea, suggesting underlying political motivations.

On the other side, the petitioner’s counsel questioned the transparency and fairness of the transfers, arguing that arbitrary decisions could undermine the integrity of the electoral process. Concerns were raised over the removal of officers considered close to the state administration, with allegations that such moves were disrupting governance. The issue of appointing observers from outside the state was also flagged, with arguments that such decisions should involve state consent.

Taking note of the seriousness of the dispute, a bench led by Chief Justice Sujay Paul has sought clarity on the scope and rationale behind the transfers. The case has sparked a broader debate on the balance between constitutional authority and administrative fairness, with the court set to hear the matter again after the Commission submits its detailed report.
